Terms of Service

Article 1 — Purpose

These Terms of Service (hereinafter "ToS") govern the contractual relationship between:

• sendpage.io, sendpage.io, a platform published by All-In Tech (SASU, SIRET 984 345 363 00019), hereinafter "sendpage.io", "we" or "the Platform"
• Any individual or legal entity subscribing to the services offered, hereinafter "the User" or "you"

Any subscription or use of the Platform implies full and complete acceptance of these ToS. They are accessible at any time on the site and take precedence over any other terms.

Article 2 — Description of services

sendpage.io is a SaaS (Software as a Service) platform for creating and publishing one-page websites for local professionals and tradespeople.

Services include but are not limited to:

• Creation of one-page websites via a guided form
• Hosting of created websites on sendpage.io infrastructure
• Activation of subdomains (*.sendpage.io) and custom domains
• Payment collection on behalf of third parties via Stripe Connect
• AI-assisted content generation and optimization
• Dashboard for managing sites and payments

Article 3 — Pricing plans

The available subscription plans are as follows:

Current prices are displayed on the website's pricing page. They are expressed in euros, including all taxes. sendpage.io reserves the right to change its prices at any time; any change will be notified by email to Users with an active subscription with a minimum notice of 30 days. The new price will apply from the next renewal.

Article 4 — Subscription and contract formation

Subscription to a paid plan is done online via the Platform. The process is as follows:

1. Creation of a user account (email + password)
2. Selection of a pricing plan
3. Entry of payment information via Stripe
4. Payment validation and immediate plan activation

The contract is deemed formed on the date of payment validation by Stripe. The User receives a subscription confirmation by email to the address associated with their account.

Article 5 — Payment methods

Payments are processed by Stripe Payments Europe, Ltd., a licensed payment service provider. sendpage.io does not collect, store, or have access to Users' banking data.

Subscriptions are automatically charged, monthly or annually depending on the User's choice, to the registered payment method. In case of payment failure, Stripe will make up to 3 automatic retry attempts. Failing resolution, access to paid features will be suspended.

The User can update their payment information at any time from their dashboard, via the Stripe portal.

Article 6 — Transactions via Stripe Connect

No commission is charged by sendpage.io on transactions collected via payment links created on the Platform. The full amount collected (excluding Stripe fees) goes to the User.

Stripe processing fees (percentage + fixed amount per transaction) are always borne by the User, regardless of the subscribed plan.

Article 7 — Stripe Connect and third-party payment collection

sendpage.io allows Users to collect payments from their own clients via Stripe Connect (Standard). The User connects their own Stripe account to the Platform via Stripe's Hosted Onboarding process.

The User is solely responsible for their Stripe Connect account, its regulatory compliance (KYC, tax obligations) and the commercial relationship with their end clients. sendpage.io acts solely as a technical intermediary facilitating the creation of payment links.

Funds are paid directly to the User's Stripe account, according to Stripe's payout terms and conditions.

Article 8 — Right of withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium whose performance has begun with the consumer's prior express consent, who has waived their right of withdrawal.

By accepting these ToS and immediately activating the services, the User expressly acknowledges waiving their right of withdrawal. However, the User may cancel their subscription at any time (see Article 9).

Article 9 — Duration and termination

Subscriptions are taken out for an indefinite period with monthly or annual billing periods.

Cancellation by the User: the User may cancel their subscription at any time from their dashboard, without fees or penalties. Cancellation takes effect at the end of the current billing period. Access to paid features is maintained until that date. No pro-rata refund is issued.

Cancellation by sendpage.io: sendpage.io reserves the right to suspend or terminate an account, without notice or compensation, in case of:

• Violation of these ToS
• Fraudulent or abusive use of the Platform
• Publication of manifestly unlawful content
• Non-payment after reminders

Consequences of termination: after termination, the User's sites remain accessible in read-only mode for 30 days, then are deactivated. Data is deleted in accordance with our Privacy Policy.

Article 10 — User obligations

The User agrees to:

• Provide accurate and up-to-date information when registering
• Maintain the confidentiality of their login credentials
• Not use the Platform for unlawful purposes or purposes contrary to public morals
• Not publish content infringing on third-party rights (intellectual property, privacy, defamation)
• Not attempt to circumvent the technical limitations of their plan
• Comply with applicable French and European legislation

Article 11 — Availability and maintenance

sendpage.io strives to keep the Platform accessible 24/7. However, access may be temporarily interrupted for maintenance, updates or in case of force majeure, without giving rise to compensation.

sendpage.io will inform Users as far as possible of any scheduled maintenance likely to affect service availability.

Article 12 — Limitation of liability

sendpage.io acts as a host within the meaning of Article 6-I-2 of French Law No. 2004-575 of June 21, 2004 on confidence in the digital economy (LCEN).

sendpage.io cannot be held liable for:

• Content published by Users on sites created via the Platform
• Direct or indirect damages resulting from the use or inability to use the Platform
• Loss of revenue, data, or profits, even if sendpage.io has been informed of the possibility of such damages
• Failures, interruptions or unavailability of third-party services (Stripe, Supabase, Vercel, Cloudinary)
• Inaccuracy of information published by Users

In any event, sendpage.io's total liability is limited to the amounts actually paid by the User during the 12 months preceding the event giving rise to liability.

Article 13 — Force majeure

sendpage.io shall not be held liable for any failure to fulfill its obligations resulting from a case of force majeure as defined by Article 1218 of the French Civil Code, including but not limited to: natural disasters, pandemics, wars, strikes, telecommunications network failures, infrastructure provider outages (Vercel, AWS, Stripe), governmental or regulatory decisions.

Article 14 — Personal data

The methods of collection and processing of personal data are described in our Privacy Policy, which forms an integral part of these ToS.

Article 15 — Mediation and dispute resolution

In case of dispute, the User is invited to contact sendpage.io at contact@sendpage.io to seek an amicable solution.

In accordance with Articles L.611-1 and following of the French Consumer Code, the consumer User has the right to free recourse to a consumer mediator for the amicable resolution of the dispute. The User may also submit their complaint on the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.

Article 16 — Applicable law and jurisdiction

These ToS are governed by French law. In case of dispute, and after failure of any attempt at amicable resolution or mediation, French courts shall have exclusive jurisdiction, in accordance with applicable territorial jurisdiction rules.

Article 17 — Modifications to the ToS

sendpage.io reserves the right to modify these ToS at any time. Users with an active subscription will be notified by email of any substantial modification at least 30 days before it takes effect. Continued use of the services after the new ToS take effect constitutes acceptance thereof.
